Asbestos litigation represents one of the longest, most expensive mass torts in U.S. history. It deals primarily with lawsuits and claims associated with health issues due to exposure to asbestos, including malignant conditions such as mesothelioma and lung cancer, and nonmalignant conditions such as asbestosis.
The litigation of asbestos-related cases began in the late 1960s, peaking in the 1980s, and it continues to this day due to the long latency period of asbestos-related diseases. These lawsuits often revolve around issues of product liability, negligence, and workers' compensation, with companies that mined asbestos or manufactured asbestos-containing products as the common defendants.
In such complex and high-stake cases, the role of an expert witness is invaluable. Expert witnesses bring a level of proficiency to the court that is often beyond the knowledge base of the average person or even the average attorney.
In asbestos litigation, expert witnesses typically come from several fields:
Medical Experts: They testify about the diagnosis, treatment, prognosis, and cause of asbestos-related diseases. Their testimony is vital to establish the link between asbestos exposure and the health issues suffered by the plaintiff.
Industrial Hygienists or Occupational Experts: They discuss the nature of asbestos, its uses, its dangers, and the likelihood of exposure in different occupations and settings. Their testimony helps establish the likelihood of the plaintiff’s exposure to asbestos.
Product Identification Experts: They identify specific products and link them to the defendants, helping to establish the chain of liability.
The importance of expert witnesses in asbestos litigation can't be overstated. They not only provide the scientific and medical foundations upon which these cases are built but also translate this specialized knowledge into information that a judge or a jury can understand and use to make informed decisions.
Given the severity of asbestos-related diseases and the potential for large-scale compensation, the credibility and clarity of expert witnesses are paramount. Their testimony often tips the scales between the plaintiff's and the defendant's claims, adding an essential layer of substantiation to the proceedings.
